Do You Need an Attorney for a Social Security Disability Claim?
The Social Security Administration routinely denies most initial applications and most Requests for Reconsideration. The third (and usually last) step in the process is a hearing with an administrative law judge of the Office of Hearings and Appeals. If you have not retained an attorney before your hearing, you should seriously consider it.
To win a Social Security Disability case or a Supplemental Security Income case, the disabled claimant must prove his or her total inability to engage in substantial gainful employment. This is done by fitting the case into either the “Listings of Impairments” or the “Medical-Vocational Guidelines.” The difficulty is finding the medical evidence that matches and supports your claim. Doctors write medical records to aid treatment, not to answer the questions of a Social Security judge. Supporting medical evidence is usually hard to find, but an experienced attorney can search through your records and find the medical evidence needed to win your case.
The Social Security rules limit attorney’s fees to 25 percent of past-due benefits, with a current overall cap of $9,200. 42 U.S.C. §406(a). Attorney fees are contingent upon winning the case. If no past-due benefits are awarded, no fee is charged or collected.
