The Social Security Administration almost always denies the initial application and the Request for Reconsideration. The third (and usually last) step in the process is to request a hearing before an Administrative Law Judge with the Office of Hearings and Appeals. This is done by fitting the case into either the “listings” or the “medical-vocational guidelines,” and it is a difficult task.
The Administration limits attorney’s fees to 25 percent of past-due benefits, with an overall cap of $6,000. If no past-due benefits are awarded, no fee is charged.
