The Social Security Administration almost always denies the initial application and the Request for Reconsideration. The third (and usually last) step in the process is to request a hearing before an Administrative Law Judge with the Office of Hearings and Appeals. If you have not retained an attorney before this step, you should seriously consider hiring one.

Very few people are able to win a Social Security Disability case on their own. To win a Social Security Disability or Supplemental Security Income case, the injured or disabled person must prove his or her total inability to perform substantial gainful employment. This is done by fitting the case into either the “listings” or the “medical-vocational guidelines,” and it is a difficult task.

The Administration limits attorney’s fees to 25 percent of past-due benefits, with an overall cap of $6,000. If no past-due benefits are awarded, no fee is charged.
